Sao Paulo's prison guards have been told to shoot at any helicopters that come too close after a jailbreak in January.
No-one at Hortolandia prison knew it was about to land. The helicopter made an emergency landing. No-one was injured.
The guard says he was only carrying out the duties laid down by Sao Paulo governor Geraldo Alckmin after last month's jail break which used a helicopter, Jornal da Tarde reports.
A police spokesman says the prison authorities weren't told about the helicopter's arrival because it was a secret operation.
He says they should have told the prison and are investigating how the lines of communication broke down.
